1. Scope

• These General Terms and Conditions apply to all orders placed by consumers (Section 13 German Civil Code, BGB) via our online shop.

• (3) The contract is concluded when we accept your order by sending an order confirmation via email.

4. Prices and shipping costs

• (1) All prices are stated in euros and include statutory VAT.
• (2) In addition to the stated prices, we charge shipping costs. The amount of the shipping costs will be displayed during the ordering process.

5. Delivery and availability

• (1) We deliver within Germany and to selected EU countries.
• (2) Unless otherwise stated, delivery time is 3-7 working days.
• (3) If a product is unavailable, we will inform you without undue delay. Any payments already made will be refunded promptly in this case.

6. Payment terms

• (1) Payment can be made by bank transfer in advance (prepayment), PayPal, credit card, or other payment methods offered in the shop.
• (2) If you select “prepayment,” we will provide our bank details in the order confirmation. Delivery will take place after receipt of payment.

7. Right of withdrawal

• Consumers have a statutory right of withdrawal.
• Instructions on withdrawal:

  • The withdrawal period is 14 days from the day on which you or a third party named by you takes possession of the goods.

• Effects of withdrawal:
  • If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for any additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days.
  • We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
  • You must return the goods to us without undue delay and in any event no later than 14 days.
  • You will bear the direct cost of returning the goods.
• Exclusion of the right of withdrawal:
  • No right of withdrawal exists for perishable food products.
  • No right of withdrawal for products that are sealed for health protection or hygiene reasons and were unsealed after delivery.

8. Retention of title

• The goods remain our property until paid for in full.

9. Warranty and liability

• (1) Statutory warranty rights apply.
• (2) We are liable for damage only in cases of intent and gross negligence, as well as for breaches of essential contractual obligations.

11. Final provisions

• (1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• (2) If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
• (3) The place of jurisdiction for all disputes shall be, to the extent permitted by law, the registered office of Besler Food GmbH.
